You may be asking yourself the following question:  How much time do I have to file a lawsuit for the injury or death of my child?

A lawsuit for injuries to a minor (a person under the age of 18) must be filed within 2 years after the minor's 18th birthday.

A lawsuit for the death of a minor, must be filed within two years from the date of the minor's death.
   
It is also important to be aware that the parents of a minor have a claim for past and future medical expenses incurred prior to the date that their child turned 18.  That claim must be brought within two years from the date of the injury.  Also, if the minor’s parents have a claim for emotional distress for having witnessed the wrongful or negligent acts, that claim must be brought within two years from the date of the injury.
